Important Limitations and Requirements in the Copyright Licenses
Artist Approval
The NFT holder must obtain the artist's consent to produce all fashion articles featuring the NFT art, and the artist may seek compensation or other requirements directly from the NFT holder. However, the NFT holder is the exclusive owner of the copyright (for fashion articles), so the artist may not use the design for clothing or fashion-related purposes without the NFT holder's consent. Similarly, the NFT holder does not have an obligation to produce any clothing at all.
This limitation is part of the stitched.eth ecosystem for the benefit of the artist, so that both the artist and the NFT holder have equal bargaining power.
Clothing Allocations
The amount of clothing or other fashion articles that NFT holders may produce is limited in order to provide a certain level of scarcity for the artwork. You can think of the clothing as numbered prints signed by the artist, and stitched.eth ensures transparency related to the scarcity and authenticity by registering and recording the uses. Anyone can view the number of fashion articles that have been produced and the remaining number that are able to be produced. If you are considering purchasing an NFT to produce clothing, you can look at the Current Allocation to determine how many you may produce immediately upon obtaining the NFT.
The total number of fashion articles authorized by the license agreement increases each year by the Yearly Allocation number (which is 500 for the Zombie Clown series) and is reflected by the Total Allocation attribute found in the NFT metadata. The NFT holder must report the number of garments produced as they are manufactured, and the Number Produced attribute (found in the NFT metadata) increases accordingly. The Current Allocation is the difference between the Total Allocation and the Number Produced, which reflects the remaining number of garments that the current NFT holder may produce at any given time. The Current Allocation as well as the production and allocation records may be found below and in the on-chain metadata.
If the NFT holder does not produce any clothing, the Current Allocation increases each year by the Yearly Allocation number, and the accumulated allocation transfers to the next NFT holder.
Reporting Obligations
NFT holders must report to stitched.eth all fashion articles produced that incorporate the NFT artwork. The NFT holders must send a photo and other descriptive information to stitched.eth so that the allocation usage can be recorded in the Production and Allocation charts. NFT holders may also mint NFTs for each fashion article and request them to be registered with stitched.eth. This way, each of the garments can be authenticated with the corresponding NFT as a proof of authenticity. stitched.eth can perform the NFT minting and recording service for a small fee.
If the NFT holder does mint NFTs for each garment, you can also use the Production and Allocation charts below to authenticate garments by referencing the linked NFTs. The linked NFT represents the digital certificate of authenticity, and the NFT should be transferred along with the clothing so that the purchaser of the clothing also has the certificate of authenticy.
